1. About These Terms

These Terms & Conditions ("Terms") are an agreement between you and Anchr Digital Health Pty Ltd (ACN 696 944 537), an Australian company ("Anchr", "we", "us", "our"). They apply to the Anchr mobile app, our websites and related services (together, "the App").

By creating an account or using the App, you agree to these Terms. If you do not agree, please do not use the App.

These Terms should be read with our Privacy Policy. Some features also ask for a separate consent inside the App (for example, AI processing, sharing with a clinician, and AI note drafting for a telehealth session). Those consents sit alongside these Terms.

Nothing in these Terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded. Section 13 explains how this works.

2. Who Can Use Anchr

  • You must be at least 16 years old to use the App.
  • If you are 16 or 17, you confirm that a parent or guardian has read these Terms with you and agrees to your use of the App, and that any purchase is made with their permission.
  • You must give accurate information when you create your account and keep it up to date.
  • One person, one account. Do not share your account or create an account using someone else's identity or contact details.
  • Keep your login details secure and tell us straight away at privacy@anchr.health if you think someone else has accessed your account. We may suspend an account while we look into a suspected compromise.
  • If you sign in with Apple or Google, their terms and privacy policies also apply to that sign-in.

3. What Anchr Is

Anchr is a mental wellbeing app that gives you evidence-informed self-help tools. Depending on your plan, it includes:

  • Mood and wellbeing check-ins, with insights over time
  • Structured self-care modules and lessons that draw on cognitive behavioural (CBT), dialectical behaviour (DBT), acceptance and commitment (ACT), psychodynamic and interpersonal approaches
  • Anchr Guide, an AI self-help guide with two modes: Explore & Discover (to find a pathway of modules that fits you) and Talk It Through (to practise skills in conversation)
  • The Toolkit: short practical skills, including a personal safety plan
  • Real Life, for planning and reflecting on real-world steps
  • Living Compass, Thought Defusion, the Vulnerability Vault, Digital Sunset, Anchr Moments, the Human Challenge and the AI Relationship Audit
  • Anchor Someone, for anonymous peer encouragement
  • Find a Clinician and Share with My Clinician, to help you connect with professional care
  • Features for people who see a clinician who uses Anchr, including shared plans and telehealth video sessions (see section 6)

You can use Anchr on your own, or alongside your own clinician. The tools are the same either way.

Anchr's self-help tools and Anchr Guide provide general wellbeing information and skills practice. They do not diagnose, treat or give medical or psychological advice, and they are not a substitute for care from a qualified health professional. When you work with your own clinician through Anchr, your clinician (not Anchr) provides and is responsible for your clinical care.

We keep improving the App, so features may be added, changed or removed. If we remove or materially reduce a paid feature during a period you have paid for, you can cancel, and your rights under section 13 apply.

4. Anchr Guide and Other AI Features

4.1 What the AI Does

Anchr Guide and some other features use an AI model (Claude, provided by Anthropic, PBC) to generate responses. To personalise its support, the AI can use context you have already given Anchr, such as your pathway, lessons, recent check-ins and, if you are linked to a clinician, the plan your clinician has set. It may also summarise conversations, identify themes, estimate standard wellbeing screening measures (which are not shown to you), suggest modules, and suggest when professional support may help.

4.2 Limits of AI

  • AI responses can be inaccurate, incomplete or unsuitable for your circumstances.
  • The AI does not know your full history and cannot assess you the way a clinician can.
  • Use your own judgement. Do not rely on AI responses instead of advice from a qualified professional.
  • If anything in the App upsets you or makes things worse, stop and seek support from a professional or someone you trust.

4.3 What Anchr Guide Will Never Do

  • Diagnose you or apply diagnostic labels
  • Prescribe medication or advise you to change prescribed treatment
  • Claim to be a person or a qualified clinician
  • Replace your relationship with a qualified health professional

4.4 Your Consent

AI processing needs a separate consent that you give after accepting these Terms. You can withdraw it at any time in Settings. Withdrawing stops new AI requests but cannot undo processing that has already happened, and it does not cancel a subscription. Our Privacy Policy explains what is sent and to whom.

4.5 Healthy-Use Limits

AI sessions have daily and monthly limits and a maximum length. These limits are part of how Anchr encourages healthy, practice-focused use. Your current limits are shown in Profile > Subscription.

5. Safety and Crisis Situations

Anchr is not an emergency or crisis service. If you or someone else is in immediate danger, call 000 in Australia (or your local emergency number). For 24/7 crisis support in Australia, call Lifeline on 13 11 14.
  • The App looks for signs of crisis in what you write and shows support resources when it finds them. This is automated. It can miss things or misread them, so please do not rely on it to keep you safe.
  • Anchr staff do not monitor your activity in real time and cannot send help to you.
  • If you are linked to a clinician, they may see safety flags depending on your sharing settings. Your clinician is not monitoring the App in real time and may not respond straight away. Do not rely on Anchr to reach your clinician in an emergency.
  • Crisis line details in the App are general guidance. They are run by independent organisations and we cannot guarantee their availability.

6. Using Anchr With Your Clinician

6.1 Linking With a Clinician

You can link your account to a clinician who uses Anchr, using an invite code or link from them, or by requesting a connection through Find a Clinician. Before anything is shared, you choose what your clinician can see. Each category you share includes what you have already recorded in it, as well as what you record while linked. You can change those choices at any time and unlink at any time from your Profile.

6.2 Your Clinician Is Independent

Clinicians who use Anchr are independent practitioners. They are not Anchr's employees or agents. Your clinician decides your clinical care, including any modules they assign, the pacing of your pathway, a weekly focus, safety planning and their session notes. Your clinician is responsible for that care, for their professional conduct, for their fees and their own terms, and for their own privacy and record-keeping obligations.

We review practitioners who join Anchr, but we do not guarantee any practitioner's registration, qualifications or the quality of their care. You can check a registered practitioner (such as a psychologist) on the Ahpra public register. If you have a concern about a practitioner, you can raise it with them, with us, with the Australian Health Practitioner Regulation Agency (Ahpra) for registered professions, with their professional association, or with your state's health complaints body (in New South Wales, the Health Care Complaints Commission).

6.3 What Changes When You Are Linked

  • Your clinician can set your pathway. While you are linked, options to change it yourself (such as Refine and Explore & Discover) are switched off, and reassessment happens with them. If the link ends, your pathway and progress stay with you, and Explore & Discover and reassessment are available again on the usual terms.
  • Anchr Guide uses your clinician's plan and weekly focus when it talks with you, and leaves some topics for your sessions.
  • Your clinician can assign Toolkit skills and work on a safety plan with you.
  • Your clinician's session notes are their clinical records. They are not shown in the App. You can ask your clinician for access to your records under privacy and health records laws.

6.4 Your Subscription While Linked

While you are linked to a clinician whose practice uses Anchr, Anchr Subscription features are included at no cost to you. Talk it Through is included once your clinician switches it on for you: clinicians choose which of their clients have it, and it may pause while their practice's Anchr plan is not active.

Included access ends when the link ends, whether you or your clinician ends it, and the free tier then applies unless you subscribe yourself. If you pay for your own Anchr Subscription, it continues as normal and is not affected by linking or unlinking.

6.5 Telehealth Video Sessions

  • Your clinician can hold video sessions with you in the App. You need a stable internet connection and a private place to talk.
  • Telehealth is not for emergencies. Before each session you will be asked which state you are in, so your clinician can contact emergency services if needed.
  • For each session you choose whether to allow AI note drafting. If you allow it, the session audio is recorded and transcribed to help your clinician draft their notes, and the audio is deleted once your clinician signs the note (within 7 days at most). If you join without AI, the call is not recorded.
  • Do not record a session yourself without the consent of everyone in it. Recording a private conversation without consent may be unlawful.

6.6 Session Fees and Payments

Your clinician sets their own fees and cancellation policy. If your clinician bills you through Anchr, you save a card in a secure Stripe form and sign an authorisation for the charges it covers. Your card is stored and charged by Stripe on your clinician's behalf, and Stripe's terms apply. Neither Anchr nor your clinician sees your full card details.

  • Your clinician can charge your saved card after a session, or for a cancellation or no-show fee under their policy, without you needing to be present.
  • Stripe emails you a receipt for each successful charge.
  • If your bank asks you to approve a charge, we email you a secure link to approve it with your bank. Nothing is charged unless you approve it.
  • Refunds are made by your clinician and go back to the card you paid with.

Anchr provides the technology and charges your clinician a platform fee on these payments of between 0.25% and 1% of each payment, depending on their Anchr plan, plus GST. The fee comes out of your clinician's share and does not change what you pay. Questions about a fee or a refund should go to your clinician first.

6.7 Ending a Link

You or your clinician can end the link at any time. When it ends, your clinician can no longer see new information from your account. Information already shared, and records your clinician has made, may be kept by your clinician where the law requires them to keep clinical records.

7. Peer Support and Content Rules

Anchor Someone lets users send each other short, anonymous messages of encouragement. Peers are other users. They are not trained or registered professionals, and peer messages are encouragement only, not advice.

7.1 Please Do Not

  • Harass, bully, threaten, or use hateful or abusive language
  • Share identifying details about yourself or anyone else, or ask to make contact outside the App
  • Post spam, promotions, or explicit, violent or unlawful content
  • Give clinical or diagnostic advice, recommend medication changes or claim professional authority
  • Impersonate anyone, or try to get around moderation or safety features

7.2 Moderation, Reporting and Blocking

Peer messages are screened automatically before delivery. You can report any message you receive and block anyone, and you can review blocked users in Settings. We may hide or remove content, and restrict or close accounts, for breaches of these rules. If you think we got a decision wrong, email privacy@anchr.health.

7.3 Your Content

Content you create stays yours. You give us a licence to store, display and moderate peer messages within the App, only as needed to run the feature. Private content (such as journal entries, Vault items, mood logs and conversations with Anchr Guide) is never shown to other users. It is shared with your clinician only if you choose to share it.

If you believe content in the App infringes your copyright, email privacy@anchr.health with the subject "Copyright", describing the work and where the content appears.

8. Subscriptions and Payments

8.1 Plans

Anchr has a free tier and a paid subscription (the "Anchr Subscription"). What each includes, the price, and any free trial or introductory offer are shown in the App before you buy and on the App Store or Google Play listing.

8.2 Billing

Subscriptions are bought and billed through the Apple App Store or Google Play, under their payment terms. We use RevenueCat, Inc. to keep your subscription status in sync. We never see your payment card details for subscriptions. Prices include GST where it applies.

8.3 Automatic Renewal

SUBSCRIPTIONS RENEW AUTOMATICALLY. Unless you cancel at least 24 hours before the end of the current period, your subscription renews for another period at the then-current price and your Apple or Google account is charged. Free trials convert to a paid subscription in the same way unless you cancel at least 24 hours before the trial ends.

8.4 Cancelling

Cancel at any time in your Apple or Google account settings. Your subscription stays active until the end of the period you have paid for. Deleting your Anchr account does not cancel an Apple or Google subscription, so please cancel it there as well.

8.5 Refunds

Apple and Google handle refund requests for purchases they bill (reportaproblem.apple.com, or Google Play order history). Nothing in these Terms limits your rights under the Australian Consumer Law. If the App has a major failure, you are entitled to a remedy, and we will help you obtain it. If you are in the EU or UK, you may also have a right to withdraw from a digital-content purchase within 14 days, which ends once you start using the paid content.

8.6 Price Changes

We will give you at least 30 days' notice of a price increase, in the App or by email, and Apple or Google will ask for your consent where they require it. You can cancel before the new price applies.

9. Using the App Responsibly

When you use the App, you agree not to:

  • Use the App for anything unlawful, or to harm, harass, stalk or deceive anyone
  • Access accounts, data or systems that are not yours, or test, probe or attack the App's security
  • Reverse-engineer, copy or interfere with the App, or get around its safety, moderation or licensing features
  • Use bots, scrapers or other automated tools to access the App or extract its content
  • Use the App or its content to build, train or evaluate an AI model
  • Introduce malware or anything else designed to damage the App or other people's devices

If you live with a serious or worsening mental health condition, please use Anchr alongside professional care rather than instead of it.

10. Privacy and Your Data

Our Privacy Policy explains how we handle your information under the Privacy Act 1988 (Cth), the Australian Privacy Principles and health records laws such as the Health Records and Information Privacy Act 2002 (NSW). In short:

  • We never sell your information or use it for advertising.
  • AI processing, sharing with a clinician and AI note drafting each need your separate consent.
  • You can export your data from Settings and delete your account at any time.
  • When you delete your account, your data is deleted from our systems. Security audit logs are kept in anonymised form, and backups clear within 30 days.
  • If you are linked to a clinician when you delete your account, the records held in Anchr for that link, including your clinician's session notes, are also deleted from Anchr. Your clinician may be required by law to keep clinical records and may keep copies outside Anchr.

11. Intellectual Property

The App and its content (including modules, lessons, designs, software and trade marks) belong to Anchr or our licensors. Modules written by your clinician belong to your clinician or their licensors.

We give you a personal, non-exclusive, non-transferable licence to use the App for your own non-commercial purposes while you follow these Terms. You may not copy, sell or make derivative works from App content without our written permission.

If you send us ideas or feedback, you agree we may use them to improve Anchr without paying you. Please do not include confidential or personal information in feedback.

12. Beta and Preview Features

Some features may be labelled "beta" or "preview". They may be incomplete or change or be withdrawn at short notice. Using them is optional. Your rights under section 13 still apply.

13. Australian Consumer Law and Our Liability

Our services come with guarantees that cannot be excluded under the Australian Consumer Law, including that they will be supplied with due care and skill. Nothing in these Terms limits those guarantees or your remedies for a failure to meet them.

13.1 What We Promise

We will supply the App with due care and skill and take reasonable steps to keep it available, secure and working as described. Because the App provides general self-help information, we cannot promise any particular outcome for your wellbeing, and the App may sometimes be unavailable (for example, during maintenance or because of an outage at a provider we rely on).

13.2 Your Decisions About Your Health

You remain responsible for decisions about your health and care, including how you use self-help content and AI responses. This does not reduce our responsibility for our own negligence or for meeting the consumer guarantees.

13.3 Care From Your Clinician

We are not responsible for the clinical care, advice, fees or conduct of independent practitioners, except to the extent a loss is caused by our own breach of these Terms, negligence or breach of law.

13.4 Limits on Liability

  • To the extent the law allows, we are not liable for indirect or consequential loss, or loss of profits or opportunity, that was not reasonably foreseeable.
  • To the extent the law allows, our total liability to you for all claims about the App is limited to the greater of A$100 and the amount you paid for the App in the 12 months before the claim. Where a consumer guarantee applies and our liability can lawfully be limited, it is limited to supplying the services again or paying the cost of having them supplied again.
  • These limits do not apply to liability that cannot lawfully be limited, including for death or personal injury caused by our negligence, fraud, wilful misconduct or a breach of privacy law.

14. Your Responsibility for Misuse

If you use the App unlawfully or deliberately breach these Terms (for example, by posting unlawful content), you are responsible for the reasonable losses and costs this causes us, except to the extent we caused or contributed to them.

15. Suspension and Closing Accounts

  • You can stop using the App and delete your account at any time in Settings, or by emailing privacy@anchr.health.
  • We may suspend or close your account if you seriously or repeatedly breach these Terms, if we must do so by law, or if it is reasonably necessary to protect the safety of other users or the App. Where it is reasonable to do so, we will tell you why and give you a chance to respond first.
  • If we stop offering the App, we will give you at least 30 days' notice and a chance to export your data. If we close your account for a reason other than your breach, we will help you get a refund for any unused period you have paid for.

16. Changes to These Terms

We may update these Terms to reflect changes to the App, the law or how we operate. For changes that materially affect you, we will give you at least 30 days' notice in the App or by email, and we will update the Effective Date above. If you do not agree to a change, you can stop using the App, delete your account and cancel your subscription before the change takes effect. Minor changes (such as clarifications or corrections) may take effect when published.

17. Complaints and Disputes

If something goes wrong, please contact us first at privacy@anchr.health. We will acknowledge your complaint within 5 business days and aim to resolve it within 30 days.

If you are not satisfied, you can contact NSW Fair Trading or the consumer protection agency in your state or territory. Privacy complaints can go to the Office of the Australian Information Commissioner (oaic.gov.au), and complaints about a practitioner to Ahpra or your state's health complaints body. Nothing in these Terms stops you from going to a court or tribunal.

18. Governing Law

These Terms are governed by the laws of New South Wales, Australia. You and we submit to the non-exclusive jurisdiction of the courts of New South Wales and the courts that can hear appeals from them.

If you live outside Australia, you may also have rights under the consumer and privacy laws where you live, and you may be able to bring a claim in your local courts. These Terms do not take those rights away.

19. Apple and Google

If you downloaded the App from the Apple App Store or Google Play, these Terms are between you and Anchr only, not Apple or Google, and their terms of service also apply to you.

For iOS users: Anchr, not Apple, is responsible for the App and its content, for maintenance and support, and for dealing with any claims about the App (including product liability claims, claims that the App does not meet a legal or regulatory requirement, consumer protection or privacy claims, and claims that the App infringes someone's intellectual property). To the maximum extent permitted by law, Apple has no warranty obligation for the App; if the App fails to meet a warranty that applies, you may notify Apple and Apple will refund the purchase price (if any). You confirm that you are not located in a country subject to a US Government embargo or designated as a "terrorist supporting" country, and that you are not on a US Government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

20. General

  • If a part of these Terms cannot be enforced, the rest still applies.
  • These Terms, the Privacy Policy and the in-app consents you give are the whole agreement between you and us about the App. This does not affect your rights under the Australian Consumer Law.
  • If we do not enforce a right straight away, we have not given it up.
  • You may not transfer your account or these Terms. We may transfer them to a business that takes over the App, which must honour them, and we will tell you if that happens.
  • We are not responsible for delays or failures caused by events outside our reasonable control, to the extent the law allows.
  • You agree to receive notices and agreements electronically, in the App or by email, under the Electronic Transactions Act 1999 (Cth) and similar laws. Accepting these Terms in the App has the same effect as signing them.
  • These Terms are written in English. If a translation differs, the English version applies to the extent the law allows.
  • We want the App to be accessible. If you find a barrier, email privacy@anchr.health with the subject "Accessibility".
